TERMS AND CONDITIONS OF USE

Welcome to Cupid Power Wellness ("Cupid Power", "Company", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of the website www.cupidpower.in, including all associated web pages, mobile applications, software platforms, digital tools, products, services, consultations, and related content (collectively referred to as the "Platform").

By accessing, browsing, registering on, or using the Platform in any manner, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms, our Privacy Policy, and any additional policies published on the Platform from time to time.

If you do not agree with any provision of these Terms, you must immediately discontinue use of the Platform.

1. LEGAL STATUS OF THESE TERMS

These Terms constitute a legally binding agreement between Cupid Power Wellness and any person accessing or using the Platform.

These Terms are published in compliance with applicable Indian laws, including but not limited to:

  • The Indian Contract Act, 1872;
  • The Information Technology Act, 2000;
  • The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021;
  • The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011; and
  • Any other applicable laws, regulations, notifications, and amendments issued by competent authorities from time to time.

Cupid Power reserves the right to revise, update, modify, or replace these Terms at its sole discretion without prior notice. Continued use of the Platform after any modification shall constitute acceptance of the revised Terms.

2. ELIGIBILITY

You may access or use the Platform only if:

  • You are at least eighteen (18) years of age; and
  • You possess the legal capacity to enter into a binding contract under applicable laws.

By using the Platform, you represent and warrant that you satisfy these eligibility requirements.

If you are accessing the Platform on behalf of an organization, institution, healthcare facility, or another individual, you represent that you possess all necessary authority to bind such person or entity to these Terms.

3. APPLICABILITY

These Terms apply to:

A. Healthcare Professionals

Medical practitioners, healthcare providers, wellness experts, clinics, hospitals, institutions, consultants, and their authorized representatives who are listed on, registered with, or otherwise use the Platform.

B. Patients and Consumers

Individuals seeking medical, wellness, healthcare, pharmacy, diagnostic, consultation, educational, or related services through the Platform, including their authorized representatives.

C. Other Users

Any visitor, subscriber, customer, or person accessing or interacting with the Platform in any capacity.

4. DEFINITIONS

For the purposes of these Terms:

"Account"

Means the registered user profile created on the Platform for accessing or utilizing services.

"Personal Information"

Means information capable of identifying an individual directly or indirectly, including information defined as personal data, sensitive personal data, or sensitive personal information under applicable law.

"Third Party"

Means any individual, organization, service provider, vendor, healthcare partner, logistics provider, laboratory, pharmacy, technology partner, payment gateway, or other external entity associated with providing services through the Platform.

"Force Majeure Event"

Means any event beyond the reasonable control of Cupid Power, including but not limited to natural disasters, pandemics, epidemics, governmental actions, cyber-attacks, system failures, telecommunications outages, internet disruptions, labor disputes, war, civil unrest, sabotage, or similar circumstances.

"User"

Means any person who accesses, browses, registers, purchases, subscribes to, or otherwise uses the Platform.

5. ACCOUNT REGISTRATION

To access certain features of the Platform, Users may be required to create an Account.

Users agree that:

  • All information submitted during registration shall be true, accurate, complete, and current.
  • They will promptly update information whenever changes occur.
  • They shall maintain the confidentiality of their login credentials.
  • They shall be solely responsible for all activities conducted through their Account.

Cupid Power shall not be liable for any loss, damage, unauthorized access, or misuse resulting from a User's failure to protect account credentials.

6. USER INFORMATION AND DATA COLLECTION

In order to provide services efficiently, Cupid Power may collect, process, store, and use information including but not limited to:

  • Name and identification details;
  • Contact information;
  • Demographic information;
  • Health and wellness information;
  • Consultation records;
  • Diagnostic and laboratory reports;
  • Prescription details;
  • Technical and device information;
  • IP addresses and usage analytics;
  • Communication records;
  • Payment-related information; and
  • Any other information voluntarily submitted by Users.

Collection and processing of such information shall be governed by our Privacy Policy.

7. CONSENT TO DATA PROCESSING

By using the Platform, Users expressly authorize Cupid Power to collect, store, process, analyze, transmit, and use their information for purposes including:

  • Account administration;
  • Service delivery;
  • Consultation facilitation;
  • Customer support;
  • Product fulfillment;
  • Diagnostics and laboratory services;
  • Compliance with legal obligations;
  • Security and fraud prevention;
  • Quality assurance;
  • Service improvement; and
  • Internal analytics.

Such processing may be undertaken directly by Cupid Power or through authorized service providers operating under confidentiality obligations.

8. COMMUNICATIONS

By registering on the Platform, Users consent to receiving communications from Cupid Power through:

  • Telephone calls;
  • SMS;
  • WhatsApp;
  • Push notifications;
  • Emails; and
  • Other electronic communication channels.

Such communications may relate to appointments, consultations, account verification, health reminders, transactional updates, service notifications, marketing communications, and other Platform-related activities.

Users who later reactivate or resubscribe to services acknowledge that communication permissions may be reinstated to facilitate service delivery.

9. USER RESPONSIBILITIES

Users agree to:

  • Provide accurate information;
  • Use the Platform lawfully;
  • Refrain from impersonating any individual or entity;
  • Not interfere with the operation or security of the Platform;
  • Not upload unlawful, misleading, harmful, or infringing content;
  • Comply with all applicable laws while using the Platform; and
  • Cooperate with reasonable verification requests where necessary.

Users remain solely responsible for the accuracy of information submitted through the Platform.

10. MODIFICATION, SUSPENSION, OR TERMINATION

Cupid Power reserves the unrestricted right to suspend, restrict, modify, discontinue, or terminate access to any part of the Platform at any time, with or without notice, where deemed necessary for legal, operational, security, regulatory, or business reasons.

Upon termination, access rights granted to the User shall immediately cease.
